The conviction order against the accused, Lalit D’Silva, was passed on the basis of sole testimony of the prosecutrix, Sales Executive at the Airlines, after the Court observed that her testimony had been “thoroughly consistent”. Metropolitan Magistrate Dev Saroha observed thus: “reliance can be placed on the sole testimony of the prosecutrix provided by her if testimony inspires confidence. In the present case the prosecutrix has been thoroughly consistent in her statement regarding the date on which the incident happened and how it happened from her statement given to police, in her statement under section 164 CrPC and her statement made before the Court while undergoing her examination in chief. The accused was given opportunity to cross examine the complainant and after a lengthy cross examination the complainant was able to stand her ground.” The complainant had accused Mr. Lalit of asking her inappropriate questions that intruded upon her privacy. Accordingly, an FIR was registered under Section 509 of IPC for outraging the modesty of a woman. The Court observed that there is no manner in which the “intention” of an accused to insult the modesty of a woman can be determined and the same has to be gathered from the act complained off. Reliance was placed on a Bombay High Court verdict in Prasad Shirodkar v. State. In the present case, the Court said, it is clear that the accused with intend to outrage the modesty of the complainant uttered the words complained of and just because there are no other witnesses to the incident the testimony of the complainant cannot be disbelieved. The accused had contested the testimony of the prosecutrix on to grounds: 1.She had changed the date of alleged incident in her statements2.There was a delay in lodging the FIR The Court did not entertain both these arguments and stated as follows: “Just because in her first complaint given to the company by mail dated 28.09.2011, she mentioned a different date of the alleged incident does not impact her unassailed testimony before the Court. …though delay in lodging FIR can entail serious consequences to the prosecution case, but if the delay has been satisfactorily explained then it does not casts clouds of suspicion upon the prosecution case.” Thus, the Court decided to proceed on the basis of sole testimony of the complainant. It added, “In the present case, the complainant has stated that immediately after the incident she made complaint to a number of her seniors and waited for an action to be taken against the accused, who is a senior employee of the company. She was throughly cross examined by the defence. She has further stated that only after realizing that no action will be taken against the accused she made a formal complaint. The complainant has been consistent in her explanation regarding delay and she being a woman in a social setting like ours is often subjected to many pressure in matters like these. In the present case, not only the social dignity of the complainant was on line but also there must be some professional considerations, the accused being a senior officer of the company and her boss. Thus, the explanation given by the complainant is believable.” The judgement was pronounced through video conferencing and the matter is now posted for hearing on quantum of sentence on November 17. With The Flecktones’ reunion tour all but imminent, the great banjoist Belá Fleck spoke about their motivation to reunite and what might come next. The new interview in JamBase touches upon Fleck’s many ongoing projects, mentioning work with Chick Corea, The Telluride Bluegrass Festival, his wife Abigail Washburn, and, of course, The Flecktones.Belá Fleck spoke about the reunion dates, explaining that it was his annual role at the Telluride Bluegrass Festival that brought them together.This lineup is a return to our original lineup: Victor Lemonte Wooten, Futureman and Howard Levy. We had planned on trying to get together in 2017, but somehow blocking a big time period wasn’t working for everyone, what with all the different projects and lives we now all have. So we scrapped the idea for that time. A little later Telluride Bluegrass Festival promoter Craig Ferguson got in touch to ask me what I wanted to do this year at the festival.I’ve played there every year since 1982, and I always try to bring something special. I knew that The Flecktones guys always loved coming to Telluride, so I thought, what about a much shorter commitment? Just a couple of weeks leading up to Telluride this time? I floated the idea, and it went over big. So we’re doing it. Who knows what it will lead to next.Of course, the follow-up question was about what it could lead to next. Fleck answers vaguely, but optimistically for fans who want to hear more.It’s an open book. We are all share a lot of history, and warmth towards each other. At a certain point we all felt ready for new challenges, and Flecktones had been the center of our musical lives for decades, so we decided to give it a break. He skied for a finish off the glass, but Orange center Fab Melo slid in front of him at the last moment to draw a charge.It was Siva’s second foul, but Louisville head coach Rick Pitino left him in the game. On SU’s ensuing possession, Siva was called for a reach-in near the 3-point line.And just like that, the best player on the floor for both teams to that point was relegated to the bench.‘I just picked up three stupid fouls that should never have happened,’ Siva said. ‘That was my fault. Due to winter weather conditions there is still a huge shortage in many parts of the country, including Michigan.Since December 1st, about 300 blood drives across 27 states have been forced to cancel due to the winter weather.Resulting in more than 10,500 blood donations going uncollected.“The Red Cross typically sees blood donations decline during the winter months, November, December and on into January and February. Blood donations will often take a back seat. When you cup hold that from severe weather, we here in Michigan are certainly familiar with we often see blood drives being cancelled due to a lot of snow maybe icy conditions that sort of thing. And then we get into the January, February and now we start to deal with flu season and our donors know that if they aren’t feeling well, or maybe have some symptoms that they wait and donate when they feel better. A team of six promising teenagers have been selected to play Switzerland in the U16 girls’ match at Heswall, Cheshire, on Tuesday 19 August. The players are: Louisa Brunt of Lancashire, Mollie Lawrence of Kent, Martha Lewis of Surrey, Emily Price of Warwickshire, Natasha Slater of Cumbria and Amelia Williamson of Norfolk. The reserve is Jessica Hall of Durham. The match was played for the first time last year when it was won by England. Louisa Brunt, 15, (Royal Birkdale), is from the England Golf North West U16 squad. She qualified for England Golf’s Grand Medal Final, was fifth in the Pleasington Putter and 7th in the Sir Henry Cooper Junior Masters. Louisa finished 11th in the English girls’ championship. Mollie Lawrence, 16, (Rochester & Cobham Park) trains with the South East U16 squad. She has represented England in the 2014 Scottish U16 championship, where she tied seventh, in the Irish U18 girls’ championship and in the U16 international against Spain. She was fifth in both the Bridget Jackson Bowl and Astor Salver and runner-up in the Frilford Heath Salver. Martha Lewis, 14, (St George’s Hill) is from the South U16 squad. She has already represented England this season in the match against the Spanish U16s. Martha was fourth in the English girls’ U15 championship and tied fifth in the Scottish U16 championship, having warmed up for the season with a successful trip to the USA where she was third in her age group in the Junior Honda Classic. She played all four rounds in the English women’s amateur championship. Emily Price, 14, (Cleobury Mortimer), is the new English U15 girls’ champion (image © Leaderboard Photography), having overcome a six-shot deficit with nine holes to play and finishing the event at nine-under par. She was fourth in the event last year and returned determined to win. Emily was third in the English U16 schools championship and eighth in the national schools’ championship. Natasha Slater, 14, (Furness), is from the U16 North squad. She has just claimed the biggest win of her career with victory in the Scottish U14 championship, where she was the only player – boy or girl – under par. She was third in the girls’ event at this season’s Fairhaven Trophies, following a top ten finish in the Scottish U16 open stroke play championship Amelia Williamson, 14, (Royal Cromer) is from the U16 East squad. She was runner-up in the English U16 schools championship and third in the national schools’ championship. She was 12th in the English U15 girls’ championship where she had two sub-par rounds. Earlier this season, at the age of 13, she became the youngest winner of the Mothers & Daughters foursomes – ably assisted by her two-handicap mother, Tracey. Jessica Hall, 15, (Bishop Auckland) is from the U16 North squad. She is the Durham ladies’ champion and tied for seventh place in the first event on this year’s WPGA One Day Series. But what convinced me was I thought this was a better choice for my family and I.TND: How big is it to play for a team you grew up watching and cheering for?NP: It’s pretty weird, for sure. Some of these players I grew up watching. I was 12-13 years old I grew up watching them and now I’m playing with them, so it’s pretty cool.TND: Half way through the season, with the ice time your receiving, do you still agree with your decision to play for the Leafs?NP: What it comes down to is everyone has a role on this team. So to make a team win, you’ve got to play your role to the best of your ability . . . .
